Miles M. Gersh

Miles M. Gersh graduated from Yale University cum laude in 1965 and, following completion of a Fulbright Teaching Fellowship in India, earned his law degree at Harvard Law School in 1969. Thereafter, he worked in Washington, D.C. as a legislative assistant for Congressman Robert Drinan and as a member of the city’s Public Defender Service. He was an associate at Holland & Hart in Denver and later formed Gersh & Danielson and Gersh & Helfrich, LLP. Mr. Gersh specialized in securities litigation.

Miles Gersh represented clients in a wide variety of arbitration and litigation matters. He acted as lead counsel or co-counsel in securities litigation for more than 30 years at the trial and appellate levels, including the following cases:

  • Ohio v. Arthur Anderson & Co. 570 F.2d 1370 (10th Cir. 1978)
  • First Interstate Bank v. Pring, 969 F.2d 891 (10th Cir. 1992)
  • Boettcher & Co. v. Munson, 854 P.2d 199 (Colo. 1993)
  • Central Bank v. First Interstate Bank, N.A., 511 U.S. 164 (1994)

He conducted class action litigation as lead counsel or co-lead counsel in numerous matters, including:

  • Toothman v. One-Stop Wireless of America, Inc., No. 98-CV-931 (Denver District Court)
  • Sherritt v. Envirotest Systems Corporation, No. 98-CV-8369 (Denver District Court)
  • C. de Baca v. ASARCO, Inc., No. 97-CV-6180 (Denver District Court)
  • Dore v. Envirotest Systems Corporation, No. 97-CV-1257 (Denver District Court)
  • Lawshe v. Mentor Corporation, No. 96-CV-1213 (Denver District Court)
  • Rawls v. Mentor Corporation, No. 1:18-CV-1818 (E.D. Texas)
  • Frederick v. TV Communications Network, Inc., No. 94-M-837 (D. Colo.)
